The end of discharge, "beginning of the end of civil rights?
The debate on Internet downloads and management of copyright is on the table. Sectors facing, Internet and content industry. Which law prevails, freedom of speech, or copyright?
This is a thorny issue, which I'm afraid we are addressing only a partial solution, the first battle and results greatly improved with the drafting of the Law of Sustainable Economy.
I fully understand the desire to preserve the rights of authors and publishers, but I find it intolerable to safeguard calling into question the behavior of 25 million Internet users, among whom I am, and will trample basic civil rights of this group. Also, I find it just outrageous and obviously difficult to digest than the executor of these measures is the Minister Gonzalez-Sinde, acting as judge and jury was influenced by its relationship with the audiovisual industry, having just arrived a few days ago the Ministry of Culture with a clear mission: to halt the discharge.
Piracy is worrying. It is true and we should not deny it. But so is the arrogant attitude of the management bodies of copyright, the recording industry and film production, self-proclaimed as a cultural industry par excellence (though only a small part of it!), Under which artists and creators in more than one occasion subsidized, partisan initiative greet questioning people's fundamental rights.
The bad news for the industry is that the problem is not only piracy, much less is focused on Internet sites that provide links to p2p downloads. Once they disappeared, the scenario will remain the same: the user will want to download using p2p program searching instead of searching through the web. Does not alter the picture. The problem is more serious and entrenched. We have an audiovisual industry, and especially the record-rooted in the past, with a distribution and support system obsolete, the CD. Perhaps the industry's primary concern should focus on adapting to new times, in finding new distribution channels and ultimately embrace of the digital model, betting strongly on alternative models to the traditional sale of a CD shop, each has less travel time and sense. The industry must reinvent itself. The solution is not to deal with consumers themselves, but to provide a logical alternative and real, price adjusted and consistent support to the times we live.
Intellectual property, software and multimedia, film, television and music were the big losers of the progress and the massive introduction of the Internet. But the fact remains that our country has tried this remedy with low blows to the population and measures that identify millions of citizens as pirates and criminals preventive tools through citizen who abuse and insult to intelligence, as so-called "digital canon" clearly unfair and unintelligible. Educate the user must provide valid alternatives, a new model of consumption. The solution to cope with millions of users as did the industry worldwide with fines and complaints in the courts simply prolong an agony of a model that requires a conversion. It is time to look ahead for a consensual solution, reasonable, listen, allowing the creator do its job, allowing users to maintain their rights and that does not come from the hand of someone who can be considered biased and contaminated with interest in the audiovisual industry as the current minister.
This complex scenario leaves behind Sustainable Economy Act and several uncertainties few solutions for Internet users (not to forget are more than 50% of the population of our country) and I fear that soon we have to worry that the law in hand, the Government, the music industry or film, operators or any entity associated with intellectual property rights (and SGAE has all the ballots for the winner) may monitor, spy and use these standards to illegally expand control over digital communications of citizens. Without choice by them to go over and over to judicial institutions in search of protection.
That's where the crux of the matter: the problem is not just intellectual property, the problem will come when someone has carte blanche to look through your private communications system and business. This Trojan horse sail on our computers and cause us to worry about who controls the controller, and I fear that we saw did not seem like the answer.
